The equivalence principle is the principle in building regulations that allows deviation from a rule, provided an equivalent solution achieves the same objective.
Building regulations often set performance requirements with specific calculated values. The equivalence principle creates room for innovation and tailor-made solutions, as long as the intended level of protection remains at least equal.
How the equivalence principle works
The applicant must themselves demonstrate that the alternative solution is equivalent. This is done through:
- Calculations, simulations or test reports
- Reference to recognised standards or certificates
- Substantiation by an expert or consultant
The competent authority (usually the municipality) assesses whether the substantiation is sufficient. The burden of proof lies with the party wishing to deviate from the rule.
Application
The principle is often used for:
- Fire safety, for example an alternative escape route design
- Ventilation and energy performance with innovative techniques
- Structural solutions that do not fit the standard norms
- Monuments where regular requirements cannot be met
The advantage is flexibility; the drawback is that substantiation requires time and expertise and the authority must approve it. Good documentation is essential for obtaining a permit.
